Booking Conditions
BOOKING CONDITIONS FOR PEDAL PEDAL
Our registered business name is “The Great Trails Company”, with “Pedal Pedal” being our cycling tour brand.
The following terms and conditions (‘booking conditions’) form the basis of your contract with The Great Trails Company (‘we’, ‘our’, ‘us’). Please read them carefully as they set out your and our respective rights and obligations. By asking us to confirm your booking, you are deemed to have read and agreed to these booking conditions applying to the trip arrangements on behalf of each person in your booking.
A booking is accepted when we issue a written booking confirmation. It is at this point that a contract between The Great Trails Company and you comes into existence. We reserve the right to decline any booking at our discretion. No employee of The Great Trails Company other than a company partner has the authority to vary or omit any of these terms or to promise any discount or refund.
Tour Inclusions
Each Pedal Pedal tour includes different services in terms of included activities, meals and transport. These details are included on the tour's web page. The Great Trails Company reserves the right to change inclusions as listed due to operational or other factors.
Cancellation By You
Should you (the client) choose to cancel a booking, The Great Trails Company must be notified in writing or by email.
The deposit will only refunded under the following conditions:
If the tour is sold out, we will only refund your deposit if we can find a replacement person for your place on the tour irrespective of how long in advance you cancel.
If the tour is not sold out you can cancel up to 3 months before the start of the tour for a full refund of the deposit.
Once full payment is received from a client no refunds will be provided by The Great Trails Company.
No refund will be made should you voluntarily leave a tour early.
Cancellation By Pedal Pedal
In the event that we cancel a trip, notification will be given no less than 60 days before the departure date of the trip. We will return all money paid for the trip cost less any credit card processing fees. We are not liable for any other money paid, including flight ticket purchases. Please note this excludes cancellations due to conditions outside our control such as war, natural disaster, political instability, pandemic, etc. In such an event no money will be returned by us should cancellation occur after the tour has commenced.
GENERAL HEALTH AND FITNESS
Our trips are designed for travellers of all ages assuming you are fit and healthy for the activity you have chosen. To undertake the adventurous trips we offer, you require a reasonable level of fitness and assume responsibility for your own health and suitability to join an active trip.
You must disclose any pre-existing medical conditions which may affect your ability to undertake the trip. You may be asked to provide a doctor’s clearance. If you have any concerns about your ability to undertake an active trip we strongly recommend consulting with your doctor before making a booking.
You release The Great Trails Company from any liability for anything relating to a pre-existing health condition. Any necessary medical attention required during travel will be provided by a local facility at your expense. We are not responsible or liable for any medical services obtained while on tour, or for the quality of the care or services provided.
Helmets
It is required that a compliant bicycle helmet be correctly worn by all cyclists when riding a bicycle throughout a Pedal Pedal bicycle tour. Failure to wear a helmet will result in the customer not being allowed to cycle as a part of the tour program.
Itineraries
Pedal Pedal reserves the right to change advertised itineraries before or during a tour in the interests of safety resulting from war, disease, natural disaster, safety, or changed local conditions. The escort, tour leader, or guide during a tour has the right to make any necessary changes to the itinerary for the reasons listed. Any client not adhering to changes made for these reasons will be deemed to have left the tour and no longer under the care of Pedal Pedal.
Insurance
It is a condition of participating in a Pedal Pedal tour that each traveller holds travel insurance for the duration of the trip. Insurance must include comprehensive medical and emergency evacuation. Your travel insurance details will be checked by your Group Leader on arrival at the starting point hotel.
Personal Responsibility
Due to the nature of the style and locations that Pedal Pedal operate in, Pedal Pedal and their guides, leaders, and support staff do not accept responsibility for any loss, injury, illness, damage, accident, fatality, delay or inconvenience experienced from time of departure to time of return arising out of any such adventure trip organised by Pedal Pedal.
COMPANY RESPONSIBILITY
We provide travel arrangements and services with reasonable skill and care. We will only be responsible for our employees in the course of their employment, and for our agents and suppliers (where we are not the supplier’s agent or an intermediary for an Independent Supplier) if they were carrying out the work we had asked them to do.
We will not be responsible for any loss, damage, claim or expense caused by the acts or omissions of yourself, of any other third party not connected with the provision of the travel arrangements or services, or due to an event of Force Majeure.
Please note that if the travel arrangements or services which gave rise to the claim complied with local laws and regulations, the travel arrangements and services will be deemed to have been properly performed, even if this would not be considered the case in Australia or your country of residence.
General liability limitation
Australian Consumer Law and corresponding legislation in other jurisdictions in certain circumstances imply mandatory conditions and warranties into consumer contracts (“Consumer Warranties”). These booking conditions do not exclude or limit the application of the Consumer Warranties. Other than the Consumer Warranties, The Great Trails Company disclaims all warranties.
To the fullest extent permitted by law, the maximum liability of The Great Trails Company to you under these booking conditions, in tort (including negligence) or at law is limited to arranging for the travel arrangements to be resupplied or payment of the cost of having the travel arrangements resupplied.
travelling with minors
Children aged 17 and under who are accompanied by a parent/guardian are welcome to participate in our scheduled tours providing the tour is deemed suitable by The Great Trails Company for their abilities and fitness levels. Parents or guardians undertake to accept full responsibility and supervision of and for their children at all times. We reserve the right to refuse any child from joining a tour where we feel trip demands would not be appropriate.
Privacy Statement
Some of the the personal information Pedal Pedal collects with your booking may be provided to third party suppliers. This will only be done where required for legal reasons (eg. booking flight tickets, permits, hotel bookings in some countries). Your email address will not be shared with anyone!
General
These booking conditions are governed by the law in force in Victoria, Australia. Any disputes will exclusively be dealt with by a court with by the courts of Victoria and any courts entitled to hear appeals from Victorian courts.
If any provision of these Booking Conditions is found to be unenforceable, then to the extent possible it will be severed from these conditions without affecting the remaining provisions.
Acceptance of Conditions
By payment of your booking deposit you agree to the terms and conditions as read.
